Welcome to Omics Data Solutions (“ODS”, “we”, “us”, “our”). These Terms and Conditions (“Terms”) govern your use of our website at omicsdatasolutions.com, our online courses, consulting services, and any related platforms or services. By accessing or using our services, you agree to be bound by these Terms.

2. Services Overview
ODS provides the following services:
(a) Online Courses: Self-paced and instructor-led courses in genomic data science, bioinformatics, and computational biology, delivered through our learning management system.
(b) Bioinformatics Consulting: Custom data analysis, pipeline development, and research support services for academic institutions, biotech companies, and pharmaceutical organizations.
(c) Training Programs: Workshops, corporate training, and institutional licensing for bioinformatics education.
3. Account Registration
3.1. To purchase courses or access certain services, you must create an account. You agree to provide accurate, complete, and current information during registration.
3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3. You must notify us immediately of any unauthorized use of your account at info@omicsdatasolutions.com.
4. Online Course Purchases
4.1. Pricing: All course prices are listed in US Dollars (USD) and are subject to change without prior notice. The price at the time of purchase will be honored.
4.2. Payment: Payments are processed through secure third-party payment processors (Stripe and PayPal). ODS does not store credit card information on its servers.
4.3. Access: Upon successful payment, you will receive immediate access to the purchased course content. Access is granted for a period of twelve (12) months from the date of purchase unless otherwise stated.
4.4. Taxes: Prices may be subject to applicable taxes, including VAT in South Africa (15%) and Ireland (23%), depending on your location.
5. Refund Policy
5.1. Online Courses: You may request a full refund within fourteen (14) days of purchase, provided you have not completed more than 25% of the course content. Refund requests must be submitted to info@omicsdatasolutions.com.
5.2. Consulting Services: Refunds for consulting services are handled on a case-by-case basis and depend on the scope of work already delivered. Any refund must be agreed upon in writing.
5.3. Processing: Approved refunds will be processed within ten (10) business days to the original payment method.
6. Intellectual Property
6.1. All course materials, including but not limited to videos, slides, code, exercises, quizzes, certificates, and documentation, are the intellectual property of Omics Data Solutions Pty Ltd and are protected by copyright law.
6.2. You are granted a limited, non-exclusive, non-transferable license to access and use the course materials for personal educational purposes only.
6.3. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any course materials without prior written consent from ODS.
6.4. Sharing account credentials or course materials with third parties is strictly prohibited and may result in account termination without refund.
7. Consulting Services
7.1. Consulting engagements are governed by a separate Statement of Work (SOW) or service agreement that outlines the scope, deliverables, timeline, and fees.
7.2. All data provided by clients for analysis remains the property of the client. ODS will not share, publish, or use client data for any purpose other than the agreed-upon services without explicit written consent.
7.3. ODS may reference the general nature of the engagement in marketing materials, without disclosing confidential details, unless the client objects in writing.
8. Data Privacy and Protection
8.1. ODS is committed to protecting your personal data in compliance with:
(a) The Protection of Personal Information Act (POPIA), South Africa.
(b) The General Data Protection Regulation (GDPR), European Union / Ireland.
8.2. Personal data collected includes: name, email address, billing information, course progress, and usage analytics.
8.3. We do not sell, rent, or trade your personal data to third parties.
8.4. For genomic or biological data submitted for consulting services, ODS implements industry-standard encryption and access controls. Data is stored on secure cloud infrastructure with encryption at rest and in transit.
8.5. You may request access to, correction of, or deletion of your personal data by contacting info@omicsdatasolutions.com. We will respond within thirty (30) days.
9. Acceptable Use
You agree not to:
(a) Use our services for any unlawful purpose or in violation of any applicable laws or regulations.
(b) Attempt to gain unauthorized access to our systems, other user accounts, or course content you have not purchased.
(c) Use automated tools, bots, or scripts to access or download course content.
(d) Upload malicious code, viruses, or any harmful content to our platform.
(e) Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
10. Certificates
10.1. Upon successful completion of a course, you will receive a digital certificate of completion.
10.2. Certificates are issued by Omics Data Solutions Pty Ltd and represent completion of the specified course curriculum. They do not constitute academic credit or professional accreditation unless explicitly stated.
11. Limitation of Liability
11.1. ODS provides its services and course content on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or suitability of any content for a particular purpose.
11.2. To the maximum extent permitted by law, ODS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
11.3. Our total liability for any claim arising from these Terms shall not exceed the amount paid by you for the specific service giving rise to the claim.
12. Termination
12.1. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse our platform.
12.2. Upon termination, your access to purchased courses and materials will be revoked. No refund will be provided for termination due to Terms violation.
12.3. You may close your account at any time by contacting info@omicsdatasolutions.com.
13. Governing Law and Dispute Resolution
13.1. For users in Africa: These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the jurisdiction of the courts of Cape Town, South Africa.
13.2. For users in the European Union: These Terms are governed by the laws of Ireland. Disputes shall be subject to the jurisdiction of the courts of Dublin, Ireland.
13.3. For all other users: These Terms are governed by the laws of the Republic of South Africa.
13.4. Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation within thirty (30) days of written notice.
14. Changes to These Terms
14.1. ODS reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date.
14.2. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
14.3. For material changes that affect your rights, we will notify registered users by email at least fourteen (14) days before the changes take effect.
